1. Purpose and acceptance
These terms govern access to and use of whalora.com. Accessing the site implies acceptance of them; if you do not agree with them, do not use the site. The site is informational about the services of Whalora LLC and allows contact to be initiated through a form.
2. Nature of the content
The content of this site is general and informational. It does not constitute professional advice of any kind, nor a binding offer of services. Any provision of services is governed solely by the written agreement entered into between the parties.
Figures, references and studies cited on the site are attributed to their source and reproduced for illustrative purposes. Whalora LLC does not warrant that the information is free of errors or kept current at all times.
3. Intellectual property
The Whalora brand, its distinctive signs, the visual identity system, the methods and systems described — including the System for the Digital Extension of the Mind (DEM) and the Technology Maturity and Convergence System — as well as the texts, diagrams and images on the site, are the property of Whalora LLC or its owner and are protected by applicable intellectual and industrial property law, including the United States Copyright Act and the Mexican Federal Law for the Protection of Industrial Property and Federal Copyright Law.
Consultation and partial reproduction for personal or citation purposes are permitted, provided the source is credited. Reproduction, distribution, transformation or public communication for commercial purposes without prior written authorization is prohibited.
4. Use of the contact form
By submitting the form you represent that the information provided is truthful and that you are entitled to provide the contact methods you register. Using the form to send unlawful content, unsolicited advertising or third-party data without their consent is prohibited.
Submitting the form creates no contractual relationship and does not oblige Whalora LLC to reply or to provide any service.
5. Third-party links and services
The site may contain links to third-party sites and uses external providers described in the Privacy Notice. Whalora LLC does not control and is not responsible for the content, privacy practices or availability of those sites and services.
6. Limitation of liability
To the extent permitted by applicable law, Whalora LLC shall not be liable for indirect, incidental, special, punitive or consequential damages arising from access to or inability to access the site, nor for decisions made on the basis of its informational content. The site is provided “as is” and “as available”, without express or implied warranties of merchantability, fitness for a particular purpose or uninterrupted availability.
Nothing in these terms excludes or limits any liability that cannot be excluded or limited under applicable law, including mandatory consumer protection provisions.
7. Data protection
The processing of personal data is governed by the Privacy Notice, which forms an integral part of these terms.
8. Electronic communications
By using the site or sending us a message, you agree to receive communications electronically and acknowledge that those communications satisfy any legal requirement that a communication be in writing.
9. Governing law and jurisdiction
These terms are governed by the laws of the State of Florida, United States of America, excluding its conflict of laws rules, and without prejudice to mandatory consumer protection and data protection provisions applicable in the user's jurisdiction.
For any dispute not subject to those mandatory provisions, the parties submit to the competent state and federal courts of the State of Florida, waiving any other venue that might apply. If you are a consumer resident in Mexico, you keep the right to bring proceedings before the courts and consumer protection authorities of your domicile.
10. General provisions
Severability. If any clause of these terms is held invalid or unenforceable, that clause will be construed to the minimum extent necessary to make it valid and the remainder will stay in full force.
No waiver. Failure to exercise a right under these terms is not a waiver of that right or of any other.
Assignment. You may not assign your rights or obligations under these terms. Whalora LLC may assign them in the context of a reorganization or transfer of business, giving notice at this same address.
Entire agreement. These terms and the Privacy Notice are the entire agreement between you and Whalora LLC regarding use of the site, and supersede any prior understanding on that subject. They do not affect any written services agreement entered into between the parties.
11. Amendments
Whalora LLC may amend these terms at any time. The version in force is the one published at this address, with its last updated date. Continued use of the site after an amendment implies acceptance of it.
